In the state of New York, grandparents have a limited right to visit their grandchildren. Parents still have a fundamental right to raise their children as they desire, this includes the decision to of who they want to visit. However, the court can grant visitation rights to grandparents based on what is in the best interest of the child. Grandparent visitation laws in the state of New York are much more restricted than in other states. Sometimes visitation is only allowed if one of the parents is deceased or if the court feels a grandparent intervention is absolutely necessary. It should also be noted that only natural grandparents or those by legal adoption will be considered. In some cases, the courts have stipulated that aunts, uncles and great grandparents cannot obtain rights for visitation.
